    ARTICLE 1 – ACCEPTANCE OF THE GENERAL CONDITIONS OF SALE

    The customer declares to have read and accepted these general conditions of sale before placing his order.

    The validation of the order therefore implies acceptance of these general conditions of sale. Unless proven otherwise, the data recorded by MY LITTLE WINTER FACTORY by Sandra Pfeiffer constitutes proof of all transactions made by the company and the customer.

    ARTICLE 2 – ORDERS

    The customer completes under his sole responsibility the online order form, specifying the references of the chosen products and their quantity. The customer will also specify his name and the delivery address.

    The customer is required to specify on the order form any special circumstances related to the delivery address that may complicate the delivery of the product ordered.

    In case of impossibility of delivery on the scheduled date due to special circumstances not specified by the customer when ordering, MY LITTLE WINTER FACTORY reserves the right to postpone or cancel the order. All costs related to the postponement or cancellation of the order will then be the sole responsibility of the customer.

    In the event of an input error, MY LITTLE WINTER FACTORY cannot be held responsible for the consequences in terms of delay or impossibility of delivery and/or withdrawal.

    The costs related to the reshipment of the products due to an input error by the customer will be borne by the customer. The customer can check the details of his order and the total price before sending it. The customer has the option of modifying or canceling his order before sending it to MY LITTLE WINTER FACTORY, which will acknowledge receipt of the order by sending the customer an email.

    The order will only be final after the first debit from the customer's bank account in the event of payment by credit card on the Site or bank transfer.

    MY LITTLE WINTER FACTORY reserves the right to refuse an order if a payment dispute is in progress with the customer or if the latter has not paid for an order in progress.

    ARTICLE 3 – AVAILABILITY

    Product and price offers are valid as long as they are visible on the Site and within the limits of available stocks. In the event of unavailability of a product after placing the order, the customer will be informed by email or telephone using the contact details indicated on the order form.

    The customer can cancel his order or chose an equivalent product (for the same price) on MY LITTLE WINTER FACTORY Site and inform the company.

    The customer will be reimbursed within a maximum period of 15 days from his cancellation if a replacement item is not preferred.

    Please note that very item in this e-store is unique and therefore impossible to remake.

    ARTICLE 4 – PRICE

    The prices of MY LITTLE WINTER FACTORY products are indicated on the Site in euros, all taxes included, excluding shipping costs. VAT by the sole proprietorship MY LITTLE WINTER FACTORY by SANDRA PFEIFFER is not applicable in accordance with article 293 B of the General Tax Code.

    The customer is informed of the delivery costs when ordering on the Site.

    MY LITTLE WINTER FACTORY reserves the right to modify its prices at any time but the product will be invoiced to the customer on the basis of the price in force at the time of its order validation.

    The product remains the property of MY LITTLE WINTER FACTORY until full payment has been received by MY LITTLE WINTER FACTORY.

    ARTICLE 5 – VERIFICATION OF PACKAGES ON DELIVERY

    The customer must carefully check upon delivery of the product for any apparent damage. In the event of apparent damage (for example: damaged package, already opened, missing package, etc.), the customer must refuse the product or accept it with reservations.

    The customer is informed that reservations must be made immediately with the carrier with precision directly on the delivery note, any general reservation of the type "subject to unpacking, packaging in good condition" having no value.

    The reservations must be precise and describe the damage(s) suffered by the product. If the carrier refuses to attend the unpacking of the product, it must be specified on the delivery note "the delivery person refused to attend the unpacking of the product".

    The customer is informed that the absence of written reservations on the delivery note is deemed to be the presumption of compliant delivery of the product.

    The customer must then confirm the refusal of the package or the reservations at the latest within 3 working days of delivery by simple letter to MY LITTLE WINTER FACTORY/Customer Service at: Sandra Pfeiffer, 183 bis, rue du Faubourg Poissonnière, 75009 Paris

    ARTICLE 6 – PAYMENT

    Payment for purchases is made either by credit card or on the secure banking server of banking partner Stripe.

    The customer can enter credit or debit card information, or check out with Apple Pay, to complete the purchase at MY LITTLE WINTER FACTORY.

    Bankcards accepted: Visa (credit and debit cards), MasterCard (credit and debit cards), American Express

    The order will be considered effective after confirmation of the agreement of the bank payment centres. If the bank refuses, the order will be automatically cancelled.

    ARTICLE 7 – RIGHT OF WITHDRAWAL

    In accordance with the Consumer Code, article L121-20, the customer benefits from 15 days of retractions on his purchases made on the www.mylittlewinterfactory.com Site, once his order has been validated by MY LITTLE WINTER FACTORY and up to 15 clear days after delivery of the product without having to justify reasons or to pay a penalty.

    In the event of exercising the right of withdrawal within the aforementioned period, only the price of the product(s) purchased will be refunded to the customer, the shipping and return costs remaining the responsibility of the customer.

    The customer is informed that he will have to bear the return costs when, following the customer's order validated by MY LITTLE WINTER FACTORY, the product will have left atelier of the company. The customer MUST inform MY LITTLE WINTER FACTORY by email of his decision to exercise his right of withdrawal to: hello@misspfeiffer.com

    The product must be returned or recovered by MY LITTLE WINTER FACTORY in its original and complete condition (packaging, gifts, instructions, cards, etc.) allowing it to be resold in new condition and accompanied by a copy of the purchase invoice.

    Products in poor condition are not taken back.

    IMPORTANT: note that for hygiene reasons, earring (except clip-on) cannot be returned nor exchanged.

    Also adjusted jewellery at the request of the customer cannot be returned either.

    E-gift cards are non-refundable.

    ARTICLE 8 – INTELLECTUAL PROPERTY

    All texts, comments, works, illustrations, works and images reproduced or represented on the Site are strictly reserved for MY LITTLE WINTER FACTORY/SANDRA PFEIFFER under copyright as well as intellectual property and for the whole world.

    Any reproduction or total or partial representation of the Site or of all or part of the elements found on the Site is strictly prohibited.

    ARTICLE 9 – PASSWORD MANAGEMENT

    When Customer Account will be enabled on the Site : MY LITTLE WINTER FACTORY will send the customer a password to access their customer account. This password is personal and confidential. The customer is solely responsible for the use and confidentiality of this password MY LITTLE WINTER FACTORY excludes all liability in the event of fraudulent use of this password.

    ARTICLE 10 – LIABILITY

    The products offered comply with the French legislation in force and the standards applicable in France.

    MY LITTLE WINTER FACTORY cannot be held liable in the event of the importation of a product purchased on the Site into a third country.

    It is up to the customer to check with the local authorities the possibilities of importing or using the product purchased on the Site and to comply with the applicable regulations. The customer is invited to refer to the description of each product to know its precise characteristics.

    Insofar as MY LITTLE WINTER FACTORY excludes all sales to professionals, MY LITTLE WINTER FACTORY will not incur any liability for any consequential damages as a result of these presents, operating loss, loss of profit, loss of opportunity, loss of data and files,

    ARTICLE 11 – FORCE MAJEURE

    MY LITTLE WINTER FACTORY cannot be held liable in the event of non-performance of its obligations in the event of force majeure.

    By express agreement, strikes within MY LITTLE WINTER FACTORY or its subcontractors or service providers (including carriers), theft, fire, natural disasters are considered to be cases of force majeure.

    ARTICLE 12 – NON-CONFORMITY OF A PRODUCT UPON DELIVERY

    12.1 Non-compliance of the product with the customer's order

    If the product delivered to the customer does not correspond to the product ordered, the customer may either refuse delivery by specifying the reasons for the refusal on the delivery slip, or accept the delivery and inform MY LITTLE WINTER FACTORY of the non-compliance of the product with its order.

    MY LITTLE WINTER FACTORY must be informed by the customer of the lack of conformity by email within 48 hours of delivery (or refusal of delivery) of the product to: hello@misspfeiffer.com

    • The customer must specify in this email whether or not he has accepted the delivery of the product and the references of the product ordered and/or delivered (reference number).

    • MY LITTLE WINTER FACTORY undertakes to proceed with the replacement of the product (repairable or similar item) or its reimbursement, at no cost to the customer.

    • If the product has been accepted by the customer, MY LITTLE WINTER FACTORY will specify by email or telephone the conditions for returning the non-compliant product.

    • Any return of a product by the customer will be subject to the prior agreement of MY LITTLE WINTER FACTORY.

    • A return number will be assigned by MY LITTLE WINTER FACTORY to the customer.

    • The non-compliant product must be returned or recovered by MY LITTLE WINTER FACTORY in the condition in which it was received, in its original packaging with all the elements and accessories delivered (instructions, gifts, cards, etc.).

    • The customer must also specify in writing the return number assigned by MY LITTLE WINTER FACTORY.

    • MY LITTLE WINTER FACTORY will only be able to refund or replace the non-compliant product once said product has been returned to MY LITTLE WINTER FACTORY.

    • The return costs that the customer may incur for the return of a non-compliant product will be reimbursed to the customer by MY LITTLE WINTER FACTORY on presentation of supporting documents.

    12.2 Delivery of a damaged product

    If the product is damaged during its delivery, the customer must either refuse the delivery by specifying on the delivery note the causes of the refusal, or accept the delivery but by formulating with precision written reservations on the delivery note (description of the damage observed).

    • The customer must inform MY LITTLE WINTER FACTORY of the refusal of delivery or issue or of the lack of conformity with delivery or issue by sending an email. This email must be sent to MY LITTLE WINTER FACTORY within 48 hours of delivery (or refusal of delivery) of the product, to: hello@misspfeiffer.com

    • The customer must specify in this email the product concerned (reference number) as well as the causes of the refusal of delivery or of the complaint.

    • MY LITTLE WINTER FACTORY then undertakes to proceed, at its option, to the replacement of the product (similar product) or to reimbursement, at no cost to the customer.

    • The customer is informed that when the product is delivered by carrier, MY LITTLE WINTER FACTORY' commitment to replacement and/or reimbursement is conditional on compliance with the procedure of ARTICLE 7 above, namely the formulation of written reservations on the carrier's delivery note and confirmation of these reservations with the carrier within three working days by registered letter with acknowledgment of receipt.

    • MY LITTLE WINTER FACTORY will specify to the customer by email or telephone the conditions for returning the damaged product.

    • Any return of a product by the customer will be subject to the prior agreement of MY LITTLE WINTER FACTORY.

    • A return number will be assigned by MY LITTLE WINTER FACTORY to the customer.

    • The damaged product must be returned or collected by MY LITTLE WINTER FACTORY in the condition in which it was received, in its packaging.

    • The customer must also specify in writing the return number assigned by MY LITTLE WINTER FACTORY.

    • MY LITTLE WINTER FACTORY will only be able to refund or replace the damaged product once said product has been returned to MY LITTLE WINTER FACTORY.

    • The return costs that the customer may incur for the return of a damaged product will be reimbursed to the customer by MY LITTLE WINTER FACTORY on presentation of supporting documents.

    • The refund will be made within a maximum period of 15 days from the return of the damaged product by crediting the customer's account.

    ARTICLE 13 – LEGAL GUARANTEE

    Article L211-4 of the Consumer Code:

    The seller is required to deliver goods that comply with the contract and is liable for any lack of conformity existing at the time of delivery. He is also liable for any lack of conformity resulting from the packaging.

    Article L211-5 of the Consumer Code:

    To comply with the contract, the goods must:

    1° Be suitable for the use usually expected of a similar good and, where applicable: correspond to the description given by the seller and possess the qualities that the latter has presented to the buyer in the form of a sample or model present the qualities that a buyer can legitimately expect given the public statements made by the seller in particular in advertising or labelling.

    2° Or present the characteristics defined by mutual agreement by the parties or be suitable for any special use sought by the buyer, brought to the seller's attention and which the latter has accepted.

    Article L211-12 of the Consumer Code:

    The action resulting from the lack of conformity is prescribed by two years from the delivery of the goods.

    HIDDEN DEFECTS

    Article 1641 of the Civil Code:

    The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which reduce this use so much that the buyer would not have not acquired, or would have given only a lesser price, if he had known them.

    Article 1648 paragraph 1 of the Civil Code:

    The action resulting from redhibitory defects must be brought by the purchaser within two years from the discovery of the defect.

    ARTICLE 14 – APPLICABLE LAW

    This agreement is subject to French law.

    In the event of a dispute with professional, the Courts of Paris (France) shall have sole jurisdiction, including in the event of summary proceedings and warranty claims and notwithstanding the plurality of defendants.

    MY LITTLE WINTER FACTORY by Sandra Pfeiffer cannot be held liable for damages of any kind, whether material, immaterial or bodily, which may result from a malfunction or misuse of the products. The jewellery is unique and delicate.

    No bank information related to your bank account will be transiting via MY LITTLE WINTER FACTORY Site.

    Therefore, the payment by card is perfectly secured. This way, your order is being registered after confirmation of the payment by the bank server.

    You can pay online safely by entering the card number, expiry date and security code at the back of your card in the proper spaces. The details of your credit card are encrypted with the SSL protocol (Secure Socket Layer) and never transit not coded on the net. The payment is done directly with the bank.

    LITTLE WINTER FACTORY has no access to these details and does not save them on its server. This is the reason why we have to ask for them for every purchase on our website.

    We take the opportunity of this clause to inform you that our site will NEVER send you communication, by email or other means of communication, to request a communication of YOUR BANK DETAILS.

    FIGHT AGAINST FRAUD

    The Site reserves the right to control the validity of the payment before shipping the order by all means LITTLE WINTER FACTORY by Sandra Pfeiffer will deem necessary (for instance verification of ID, proof of residency, etc…).

    The company also reserves the right to decline the shipping or to decline an order from a consumer with whom exists past or pending disputes.

    In case of fraudulent activity or suspicion of such, LITTLE WINTER FACTORY by Sandra Pfeiffer reserves the right to write off any member with no advanced notice nor compensation.

    HOW WE PROCEED WITH OUR SHIPMENTS

    The standard shipping method is a letter with registered tracking number (Lettre recommandée) delivered with signature.

    Fast delivery with DHL is also a possible shipping option. Please contact us before ordering for that methode as different rates. apply.

    Shipping costs include packaging, handling and postage. You will find detailed postage costs for the shipping of MY LITTLE WINTER FACTORY jewellery at the end of this section.

    Customs fees and other taxes are the responsibility of the customer.

    Packages are sent to the address indicated by the buyer within an average of 48 to 72 hours after receipt of payment.

    We ship orders from Monday to Friday.

    PACKAGING

    MY LITTLE WINTER FACTORY recycles all the packaging from the orders the designer Sandra Pfeiffer makes in her day-to-day life in general. The packaging she uses to send out MY LITTLE WINTER FACTORY orders is 90% recycled.

    As the packaging is already produced, we might as well reuse it ♻️

    However the packaging coming in direct contact with MY LITTLE WINTER FACTORY jewellery is new but made of reusable materials. It is packed in a little coton bag and sent with instructions for jewellery care and a polishing cloth.

    Every package/enveloppe will be sent with a tracking a number for France or abroad and preferably including an insurance in the event of loss or damage (additional cost). The packages are shock-resistant and made in the most meticulous way.

    CUSTOMER CARE

    It is possible for us to adjust length for bracelets and necklaces and to apply an hypoallergenic varnish on brass, copper or bronze, if needed by the customer.

    DELIVERY TERRITORIES

    MY LITTLE WINTER FACTORY products ordered on the Site can be shipped worldwide (subject to exceptions).

    For security reasons, MY LITTLE WINTER FACTORY company will not process orders nor ship parcels when the address is a P.O. Box or a Cedex code.

    The products are shipped to the delivery address you have enteredduring the ordering process. The Site www.mylittlewinterfactory.com cannot be held responsible for a mistake in the address you provided nor for the loss or misplacement of your parcel by the transporter.

    SHIPPING

    MY LITTLE WINTER FACTORY by Sandra Pfeiffer cannot be held responsible for delays in delivery due to La Poste, the postal French services. We thank you in advance for your patience. In case of problem, do not hesitate to get back to us directly and we will do everything possible to find a fast and efficient solution.

    The customer is required to specify on the jewellery order form (check-out) any special circumstances related to the delivery address that may complicate the delivery of the product ordered.

    The customer must carefully check upon delivery of the product for any apparent damage. In the event of apparent damage please check the instructions detailed in our Terms & conditions in the ARTICLE 5 – “VERIFICATION OF PACKAGES ON DELIVERY”.

    The customer will remain responsible for the risks (loss, theft or damages) regarding the products delivered and starting from the date of delivery to the customer.

    RIGHT OF WITHDRAWAL

    Please remember that the colours of the jewellery you see on your device may vary from one screen to another.

    LIABILITY

    DELIVERY LEAD TIMES

    For France: The average delivery lead time for mainland France runs from 24 to 48 hours for home delivery and 48 to 72 hours for delivery in a pick-up delivery spot.

    For international: for the EC (European Community) Areas 1 to 4 and overseas French departments code 1, the average lead-time runs from 72 hours to 5 days, depending on local postal services as well.

    GUARANTEE ON PRODUCTS

    All the items of MY LITTLE WINTER FACTORY by Sandra Pfeiffer bought on the e-shop have a 1-year guarantee on parts and labor from the date of purchase and for a normal use.

    Created by hand, the jewels of MY LITTLE WINTER FACTORY are rigorously controlled before being shipped. The gilt on the products are sensitive to shocks, that is why MY LITTLE WINTER FACTORY by Sandra Pfeiffer cannot bring any guarantee against the possible damage of an inappropriate use of the jewel.

    To make your plated jewel last and maintain its original shine, you can follow the instructions of USE and CARE described in the dedicated section.

    Please note that MY LITTLE WINTER FACTORY jewellery made of oxidisable metals will oxidise and this is not due to any general defect or metal defect. This concerns copper, bronze and brass parts. This is a natural occurrence and the guarantee does not cover this change.

    CONDITIONS FOR REPAIR

    For repairs you may count on about 10 working days from the moment when the return has been confirmed. An email acknowledging the good receipt of your item will be sent to you. This time frame does not include delivery time.

    AFTER GUARANTEE ON PRODUCTS

    After the expiry of the guarantee, if your item can be repaired, MY LITTLE WINTER FACTORY will be happy to establish a repair quote.

    Prior to sending back your piece of jewellery, it is important you send a detailed picture of it to hello@misspfeiffer.com to get an idea of the eventual repair. We will get back to you with a quote for labor and cost of materials as soon as possible.

    Please note that we will not be able to proceed with any repair before receiving formal approval and payment of this price quote.
